Conveyancing is the process of buying and selling residential properties. A Solicitor, Licensed Conveyancer or Legal Executive should be involved as early as possible due to the complexities involved and the time required. The conveyancer will ensure all the elements are in place to allow the exchange of contracts which commits both seller and buyer to the transaction.
Purchasing and Selling
Purchasing will require searches usually a Local Authority Search, Water and Drainage Search, Environmental Search. Depending on the results further searches may be recommended. Details of previous service costs and anticipated costs are obtained from the seller and enquiries made until a full picture relating to the property is created. You will then be advised normally by a report of anything that may adversely affect the enjoyment of your future home. The report will highlight the responses to enquiries ranging from verifying planning and building regulations to any extension or modifications to the property.
It will contain information about the title, restrictions, obligations, by which you will be bound upon purchase of the property.Commonly these covenants will restrict the property’s use to a private dwelling and require permission before making any structural alterations.
A seller does not require searched but will be relied upon to provide valid details about the property. Building regulations and appropriate certifications or planning permissions for any alterations to the property will be requested. If any are unavailable an insurance indemnity should be requested.
Upon the exchange of contracts a moving or completion date will be agreed by your conveyancer in consultation with you. The monies and transfer documents required for completion will be held by the solicitors representing the buyer and seller. On the agreed completion date the monies are sent to the seller’s conveyancer by telegraphic transfer and the signed transfer documents to the purchaser’s solicitor. The keys will then be released to the new owners normally by 12 noon unless otherwise agreed.
Then the Stamp Duty Land Tax Return is filed, the mortgage is redeemed and the transfer is registered at land registry. Land Registry will supply a copy of the title showing your details as the owner.
